Article 3. Position and Function

1.The Department of Home Affairs is a specialized agency under the District People's Committee, responsible for advising and assisting the District People's Committee in state management of the following: Organizational structure; job positions, public servant ranks, and the staffing of public servants in administrative agencies; job positions, professional titles, and the number of employees in public service units; salaries for officials, public servants, contracted workers in administrative agencies, public service units; administrative reform and public service reforms; local government; administrative boundaries; officials, public servants, and non-specialized workers at the commune level, village, and neighborhood units; associations, non-governmental organizations; state archives; beliefs and religions; youth; emulation and rewards.

2.The Department of Home Affairs has legal status, its own seal, and an independent account; it operates under the leadership, management of the organization, staffing, and work of the District People's Committee while being professionally directed, inspected, and guided by the Ministry of Home Affairs and the Department of Home Affairs.

Article 4. Tasks and Powers

1.Submit to the District People's Committee: a. Decisions within the authority of the District People's Committee: planning, development plans, and programs and measures for the organization and implementation of tasks related to the field of home affairs within the district; decentralization and delegation of state management tasks in the field of home affairs to specialized agencies under the District People's Committee and commune-level People's Committees; define the specific functions, tasks, powers, and organization of the Department of Home Affairs. b. Issue directives and guidance in the field of home affairs for agencies, organizations, and units within the district, following Party regulations, the law, and directives from higher-level state agencies.

2.Submit to the Chairman of the District People's Committee decisions on personnel appointments under the authority of the Chairman of the District People's Committee as per Party and legal regulations.

3.Organize the implementation of legal documents, plans, programs after approval by the competent authority; guide, inspect, provide information, propagate, disseminate, and educate the law, monitor law enforcement in areas within the assigned state management scope.

4.Regarding the organizational structure: a. Advise and assist the District People's Committee in submitting to the District People's Council for consideration and decision on the establishment, reorganization, or dissolution of specialized agencies under the District People's Committee. b. Appraise draft documents: regulations on the functions, tasks, powers, and organizational structure of administrative agencies, public service units under the District People's Committee; the establishment, reorganization, and dissolution of administrative organizations and public service units under the authority of the District People's Committee; the establishment, consolidation, merger, and dissolution of inter-agency coordination organizations under the authority of the Chairman of the District People's Committee according to legal regulations.

Article 5. Organizational Structure

The District Department of Home Affairs of Tuy An includes a Director, 02 Deputy Directors, and other public servants. a. The Director is responsible to the District People's Committee, the Chairman of the District People's Committee, and the law for performing the assigned functions, tasks, and powers, as well as overseeing the overall activities of the Department. b. The Deputy Directors assist the Director in managing specific tasks and are responsible to the Director and the law for the duties assigned. In the Director's absence, one Deputy Director, as authorized in writing by the Director, will manage the Department's activities.

Based on its functions, tasks, job positions, titles, standards, and public servant ranks, the Department of Home Affairs is organized into the following sections: Emulation and Reward Section; Administrative Reform – Documentation Section; Public Servant, Officer – Association Section; Local Government – Youth Section; Religious Affairs Section; and a General Advisory Section to meet the requirements of assigned duties.

Article 6. Staffing

The staffing of the Department of Home Affairs is determined by the Chairman of the District People's Committee within the total staffing of the district as assigned by the competent authority.

The assignment of work to public servants in the Department of Home Affairs is based on job positions, titles, standards, and the public servant ranks as stipulated, ensuring sufficient personnel to fulfill the assigned tasks.
