Article 3: Position and Function
The Department of Natural Resources and Environment of Tuy An District is a specialized agency under the People's Committee of Tuy An District. It performs the function of advising and assisting the People's Committee in state management over natural resources and environment, including land, water resources, mineral resources, environment, climate change, integrated management of natural resources, protection of marine and island environments, surveying, and mapping.
The Department has its own seal and account, is under the direction, management, and administration of the People's Committee of the district, and is also under the professional guidance and supervision of the Provincial Department of Natural Resources and Environment.
Article 4: Duties and Powers
Propose to the People's Committee of the district to issue resolutions, decisions, medium-term and annual development plans regarding natural resources and environment under the authority of the district's People's Council and People's Committee; submit drafts on the functions, duties, powers, and organizational structure of the Department.
Submit to the Chairman of the People's Committee of the district draft decisions and other documents regarding natural resources and environment under the authority of the district's Chairman.
Implement legal documents, plans, programs, and other documents on natural resources and environment once approved by competent authorities; disseminate legal information and monitor the implementation of laws related to natural resources and environment.
Regarding Land: a) Advise the People's Committee in preparing and adjusting district-level land-use plans and organize implementation after approval. b) Evaluate documents related to land allocation, leasing, recovery, changing land-use purposes, and issuing certificates of land use rights, house ownership, and associated properties. c) Participate in determining land prices and usage fees; organize the assessment of compensation, support, and resettlement plans; advise on land requisition decisions and land auctions.
Regarding Water Resources: a) Implement measures to protect water quality and drinking water resources; conduct surveys and classify wells that need sealing. b) Coordinate in handling water pollution incidents. c) Organize the registration of water resource exploitation and use as per authority.
Regarding Mineral Resources: a) Manage land use for mineral exploitation and related infrastructure. b) Implement measures to protect unexploited mineral resources. c) Propose measures to prevent illegal mineral exploitation.
Regarding Environment: a) Register, inspect, and supervise environmental protection plans and respond to environmental incidents. b) Collect environmental protection fees for industrial wastewater and create environmental protection reports. c) Implement biodiversity and nature conservation programs.
Regarding Marine and Island Resources Management: a) Evaluate documents related to the allocation of marine areas for aquaculture and monitor marine environment protection. b) Protect unexploited marine and island resources. c) Participate in oil spill response and monitor coastal erosion.
Manage surveying markers as assigned by the provincial authorities.
Participate in developing and implementing climate change response action plans.
Carry out state management tasks on meteorology and hydrology and participate in protecting meteorological works.
Evaluate, register, and issue licenses related to natural resources and environment as assigned.
Monitor and inspect organizations and individuals in implementing regulations on natural resources and environment, handle complaints, and combat corruption.
Implement research, apply science and technology, and manage digital transformation towards e-government.
Assist the district People's Committee in managing non-governmental organizations in the natural resources and environment sector.
Provide training and guidance on state management of natural resources and environment to relevant personnel.
Manage and use civil servants, recommend rewards, and handle discipline.
Submit periodic and ad-hoc reports on assigned tasks.
Perform other tasks as assigned by the district People's Committee or higher authorities.
CHAPTER III: ORGANIZATIONAL STRUCTURE AND STAFFING
Article 5: Organizational Structure
The Department of Natural Resources and Environment has a Head, no more than 3 Deputy Heads, and specialized civil servants. a) The Head is responsible for all activities and the fulfillment of assigned tasks. b) The Deputy Heads assist the Head and are responsible for specific duties. c) The appointment and dismissal of the Head and Deputy Heads are decided by the Chairman of the district People's Committee.
The Department is organized into sections: Land, Minerals, Environment, Water, and Marine & Islands.
Article 6: Staffing
The staffing of the Department is allocated based on the job positions, functions, tasks, and operational scope.
Each year, the Department prepares staffing plans to ensure the effective performance of its duties.
